The Court is researching appropriateness of the DA’s office request that property disposition language be added to the Court’s search warrant template. Until the Court research is completed and a decision is made by our bench, our judges have decided that they will not sign any search warrant that contains property disposition language. Justice partners will be advised as soon as our bench makes a decision about the proposed property disposition language.
Examples of property disposition language that will be cause for a judge not to sign a warrant if the warrant contains any similar language:
First example:
If, after further examination, it is determined that the property seized does not contain evidence which requires the property to be held, or after adjudication of the case(s) against all defendant(s) related to this investigation, including the resolution of any and all appeals, I request permission to return or dispose of the property in accordance with the procedures set forth in California Penal Code §§1407 to 1422, without the necessity of a further Court Order issued pursuant to California Penal Code §1536 and with the written concurrence of the Tuolumne County District Attorney’s Office.
Second example:
IT IS HEREBY ORDERED that upon adjudication of the case(s) against all defendant(s) in this action, including the resolution of any and all appeals, or with the written concurrence of the Tuolumne County District Attorney's Office, the property be disposed of in accordance with the procedures set forth in California Penal Code 1407 to 1422, without the necessity of a further Court Order, issued pursuant to California Penal Code 1536.
