Tentative Rulings and Case Notes

Please note that Tentative Rulings are available for Department 2, and occasionally may be available for other Departments. Tentative Rulings are only available for certain civil law and motion matters in unlimited civil cases. This does not include civil harassment petitions, any family law matters, or case management conferences.

If you wish to appear for oral argument, pursuant to California Rules of Court, rule 3.1308, you must so notify the court and opposing counsel by 4:00 p.m., the court day before the hearing. The court telephone number for such notification to Dept. 1 is (209) 588-2316, to Dept. 2 is (209) 588-2382, and to Dept. 3 is (209) 588-2383. 

The Tentative Ruling will become the ruling of the court if the court has not directed oral argument by its Tentative Ruling, and notice of intent to appear has not been given.

All matters set for hearing in Department 5 have been assigned by order of the Presiding Judge to be heard and decided by the Commissioner serving as a Judge Pro Tem. Parties retain the right under Cal. Const. art VI §21 to decline consent to the Commissioner serving as a Judge Pro Tem by declining at the first hearing in the case.  By participating in the first such hearing, or electing not to attend after due notice thereof, parties will be deemed to have stipulated to the Commissioner serving as a Judge Pro Tem. See CRC 2.816. Case notes are not tentative rulings. See CRC 3.1308(b). Parties and counsel are still expected to appear for the hearings unless the Note specifies otherwise.
